1. Acceptance of Terms

By accessing the Dabane Technologies website ([Insert URL]) or engaging our professional ICT, Security, or Digital services, you (“The Client”) agree to be bound by these Terms & Conditions. These terms constitute a legal agreement between the Client and Dabane Technologies (Pty) Ltd.

2. Quotations and Estimations

  • Validity: All formal quotations provided by Dabane Technologies are valid for a period of 30 calendar days from the date of issue, unless otherwise stated in writing.
  • ZAR Pricing: All pricing is provided in South African Rand (ZAR).
  • Variable Costs: Quotations for hardware (CCTV, Servers, PC Components) are subject to change based on supplier availability and exchange rate fluctuations if the order is not confirmed within 48 hours.

3. Provision of Services

  • Site Access: For onsite installations (CCTV, Networking, Server setup) in King William’s Town and surrounding areas, the Client must ensure safe and reasonable access to the premises at the agreed-upon time.
  • Project Timelines: While we strive to meet all deadlines, timelines provided are estimations. Dabane Technologies will not be held liable for delays caused by third-party suppliers, load shedding, or extreme weather conditions affecting outdoor installations.

4. Payment Terms

  • Deposits: A 50% deposit is required for all hardware-intensive projects (CCTV systems, custom server builds) before work commences.
  • Final Payment: The remaining balance is due immediately upon project completion or hardware delivery.
  • Hosting Fees: Subscription-based services (Web Hosting, Business Email) are billed monthly or annually in advance. Failure to settle hosting fees within 7 days of the invoice date may result in temporary service suspension.

5. Hardware Warranties and Liability

  • Manufacturer Warranty: All new hardware supplied (Cameras, Hard Drives, Routers) carries the standard manufacturer’s warranty. Dabane Technologies will assist in the processing of warranty claims but is not the primary warrantor.
  • Data Loss: While we exercise extreme care during Data Recovery and Server Maintenance, the Client acknowledges that data retrieval is not 100% guaranteed. It is the Client’s responsibility to maintain independent backups of critical data unless a managed backup SLA is in place with us.

6. Domain Registration and Web Hosting

  • Domain Ownership: The Client remains the legal owner of any domain registered through us, provided all fees are paid.
  • Content Legality: The Client is solely responsible for the content hosted on their website. Dabane Technologies reserves the right to suspend any hosting account found to be distributing illegal content or malware that threatens our local server infrastructure.

7. Cancellations and Refunds

  • Service Cancellation: Clients may cancel monthly hosting agreements with 30 days’ written notice.
  • Refunds: Deposits for custom-ordered hardware are non-refundable once the hardware has been procured from our suppliers.

8. Limitation of Liability

To the maximum extent permitted by South African law, Dabane Technologies shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising out of the use or inability to use our ICT systems or security installations.

9. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising shall be subject to the exclusive jurisdiction of the South African courts.
